By signing this agreement, you acknowledge and agree to the following terms regarding the use of your property for hosting an event with Rooted in Play: Assumption of Risk: By participating in a Rooted in Play birthday party, I, the undersigned, understand that the nature of the activities involved may include physical play, use of loose parts (e.g., cardboard boxes, tires, and other materials), and outdoor exploration. I acknowledge that these activities inherently carry certain risks, including but not limited to minor scrapes, bruises, and falls. I voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, that may occur as a result of my child’s participation in this event. Liability Waiver: I, on behalf of myself and my child(ren), hereby release, waive, and discharge Rooted in Play, its employees, volunteers, and contractors from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by my child(ren), myself, or any property, while participating in the event or while on the premises where the event is being conducted. Park Property and Public Space Usage: I understand that the event will take place at a local park, which is public property, and Rooted in Play does not have control over the condition of the park’s facilities or equipment. I agree that Rooted in Play is not responsible for any accidents, injuries, or damages arising from the use of park facilities or third-party equipment during the event. Damage to Property: While Rooted in Play provides a safe and engaging environment, I understand that I am responsible for any damage caused by my child(ren) or event guests to park property or Rooted in Play materials. I agree to hold Rooted in Play harmless from any claims arising from such damages. General Liability Insurance: Rooted in Play maintains general liability insurance, commercial auto insurance, and directors and officers insurance for its operations. However, this waiver extends to all claims not covered by such insurance policies, including but not limited to personal property damage, minor injuries, and risks associated with outdoor play activities.
